A class action settlement involving American Traffic Solutions, Inc. ("ATS" or "Defendant") and the PlatePass electronic toll payment service was preliminarily approved in the Seventeenth Judicial Circuit Court in and for Broward County, Florida on October 22, 2013.
Under the proposed settlement, persons who rented a vehicle from Avis or Budget in the State of Florida at any time between November 30, 2006 and November 30, 2010, and during that vehicle rental used the PlatePass electronic toll payment service and paid PlatePass service fees (also known as administrative fees), may be entitled to a cash refund payment from a class action settlement ("Class" or "Class Members" or "Settlement Class Members").
Class Members must submit a claim on this website or by mail to be eligible to receive a monetary benefit from this class action settlement. Claims must be filed online or received by mail no later than April 2, 2014. A postcard Summary Notice of Proposed Class Action Settlement was mailed on November 21, 2013 to individuals identified by Defendant as members of the Class.
A Final Approval Hearing has been scheduled for March 3, 2014, at which time the Court will make a final determination as to whether the proposed settlement is fair, reasonable and adequate and should be finally approved. Payments cannot be distributed to eligible Class Members who submit valid and timely claims until a final settlement approval order is entered by the Court.
